Do you need to move on with your life but your divorce seems like it will never end? Consider bifurcation.
In Utah the court may order separate trials on any claims or issues “in furtherance of convenience or to avoid prejudice.” Utah R. Civ. P. 42(b). You may be able to get legally divorced now reserving any remaining disputed issues for a trial that may not occur for many months.
Judges have broad discretion to bifurcate divorce proceedings. This broad discretion means that bifurcation is not guaranteed. The court will look at each request on a case by case basis. Bifurcation can be granted or denied for various reasons. To find out if your circumstances warrant bifurcation please call our office to speak with one of our experienced divorce attorneys.
